Welcome to KYKLOPS

By using Kyklops ("the Services"), you acknowledge and agree that the Services are offered exclusively through a bot on the Telegram application, a third-party service offered by Telegram Messenger Inc. ("Telegram"). Telegram controls the front end through which you access and use the Services. You are subject to additional terms for your use of Telegram, which can be accessed at telegram.org/tos and telegram.org/tos/bots.

We are not responsible for any matters, issues, complaints or disputes arising out of your use of the Telegram application, including your access to the Services through Telegram.

Restricted Jurisdictions and Persons

THE SERVICES WERE NOT DEVELOPED FOR, AND ARE NOT OFFERED TO PERSONS OR ENTITIES WHO RESIDE IN, ARE CITIZENS OF, ARE LOCATED IN, ARE INCORPORATED IN, OR HAVE A REGISTERED OFFICE OR PRINCIPAL PLACE OF BUSINESS IN THE UNITED STATES, OR ANY RESTRICTED JURISDICTION OR COUNTRY SUBJECT TO ANY SANCTIONS OR RESTRICTIONS PURSUANT TO ANY APPLICABLE LAW, INCLUDING ANY COUNTRY TO WHICH THE UNITED STATES, THE UNITED KINGDOM, THE EUROPEAN UNION OR ANY OTHER JURISDICTION EMBARGOES GOODS OR IMPOSES SIMILAR SANCTIONS, OR ANY JURISDICTIONS IN WHICH THE TRANSACTING OF CRYPTOCURRENCIES IS PROHIBITED OR RESTRICTED IN ANY FORM OR MANNER (COLLECTIVELY, THE "RESTRICTED JURISDICTIONS").

RESTRICTED PERSONS INCLUDE ANY INDIVIDUAL OR ENTITY OWNED, CONTROLLED, LOCATED IN OR ORGANIZED UNDER THE LAWS OF ANY RESTRICTED JURISDICTION, OR ANY PERSON LISTED ON ANY SANCTIONS LIST.

THERE ARE NO EXCEPTIONS. IF YOU ARE A RESTRICTED PERSON, DO NOT USE OR ATTEMPT TO USE THE SERVICES.

USE OF ANY TECHNOLOGY OR MECHANISM, SUCH AS A VIRTUAL PRIVATE NETWORK ("VPN"), TO CIRCUMVENT OR ATTEMPT TO CIRCUMVENT THE RESTRICTIONS SET FORTH HEREIN IS STRICTLY PROHIBITED.

By using the Services, you represent that:

You are not a Restricted Person
You will not use the Services from within any Restricted Jurisdiction
You are over the age of 18 or otherwise of legal age to form a binding contract
Your funds are not derived from or connected to any illegal or unauthorized sources

Nature of the Services

You acknowledge and agree that:

We are not a broker, exchange, custodian, money transmitter, or financial service provider in any applicable jurisdiction.
We do not broker trading orders on your behalf.
All transactions take place on third-party blockchain infrastructure (including but not limited to Solana, Jupiter, Raydium, and other decentralized exchanges and protocols).
The Services are a conduit to such third-party infrastructure and technologies, and are not a DEX, exchange, or broker.
We do not provide exchange between virtual assets and fiat; exchange between forms of virtual assets; transfer of virtual assets on behalf of another person; safekeeping or administration of virtual assets; or participation in financial services related to issuance or sale of virtual assets.
When you use the Services, you are interacting with third-party technology not controlled by us. We specifically disclaim any and all liability for your use of these third-party technologies.
We provide no guarantees of any kind with respect to third-party technologies, their quality, accuracy, uptime, availability, or results.

Trading Wallet

Your use of the Services requires the creation of a Trading Wallet secured by a password you choose.

We store an encrypted copy of your wallet private keys on our servers solely for the purpose of signing transactions on your behalf.
Your private keys are encrypted using AES-256-GCM with scrypt key derivation and a unique random salt per wallet.
We do NOT know your password. Your password is hashed using bcrypt (12 rounds). The original password is never stored.
We CANNOT recover your password. We CANNOT access your funds without your password. No one can.
Your private key NEVER appears in the Telegram chat. Unlike other services, we do not display, transmit, or expose your private key through Telegram messages at any point.
You are solely responsible for: securing your password, maintaining access to your Telegram account, and all activity associated with your Trading Wallet.

IF YOU LOSE YOUR PASSWORD, YOUR FUNDS ARE PERMANENTLY AND IRREVERSIBLY LOST. There is no recovery mechanism. This is by design and is what protects your funds from unauthorized access.

WE MAKE NO REPRESENTATIONS REGARDING THE SECURITY OR SAFETY OF YOUR DIGITAL ASSETS OR THE SERVICES. YOU HEREBY RELEASE AND HOLD HARMLESS KYKLOPS FROM AND AGAINST ANY DAMAGES OR LOSSES ARISING FROM LOSS OR COMPROMISE OF YOUR PASSWORD, KEYS, OR ANY TRANSACTIONS.

Fees

You may incur a transaction fee for each trade executed through the Services. Fees are subject to change at any time without notice.

You may also incur third-party fees (e.g., blockchain network fees, DEX fees) which are not charged by us and over which we have no control.

WE ARE NOT RESPONSIBLE FOR THIRD-PARTY FEES OR CHANGES IN PRICING.

Referral Program

We may offer referral rewards for referring other users to the Services. We reserve the right to modify, suspend, or cancel the referral program at any time, with or without notice. All referral rewards are calculated and paid at our sole discretion.

No Financial or Investment Advice

The Services are not registered with or licensed by any regulatory authority or governmental body.

We do not act as your financial advisor, investment manager, or commodity trading advisor. We do not give investment advice of any kind.

Safety scores, token rankings, AI analysis, whale alerts, and any other information provided through the Services are for informational purposes only and do not constitute financial advice, trading signals, or a recommendation to buy, sell, or hold any digital asset.

All trading decisions are made solely by you. You are solely responsible for your trading decisions.

NO FINANCIAL, INVESTMENT, TAX, LEGAL OR SECURITIES ADVICE IS GIVEN THROUGH OR IN CONNECTION WITH THE SERVICES.

Risks

You acknowledge and agree that:

Digital assets are volatile and risky. Their trading is affected by many factors outside our or your control.
You may lose your entire investment.
Digital assets are not legal tender and are not backed by any government.
Blockchain networks may experience delays, congestion, or failures.
Smart contracts may contain bugs or security vulnerabilities.
Tokens may be fraudulent (including honeypots and rug pulls) even if safety scores or analysis indicate otherwise.
Hackers or malicious actors may attempt to interfere with the Services through malware, denial of service attacks, or other means.
The Services may be unavailable or interrupted at any time for any reason.
Prices presented are estimates only and may change at any time, even after you have initiated a transaction.

WE WILL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR YOUR TRADING DECISIONS, LOSSES, OR THE QUALITY OF ANY TOKEN OR DIGITAL ASSET YOU BUY, SELL, OR TRADE.

Prohibited Uses

You agree not to:

Use the Services from a Restricted Jurisdiction or as a Restricted Person
Use the Services for money laundering, terrorist financing, or illegal activity
Use the Services for market manipulation (pump and dump, wash trading, front running, spoofing)
Attempt to hack, probe, scan, or attack the Services or their infrastructure
Interfere with other users' access to the Services
Impersonate Kyklops, its representatives, or other users
Use the Services to train artificial intelligence models
Collect personal information of other users
Send spam or unsolicited communications through the Services
Attempt to reverse engineer, decompile, or create derivative works of the Services
Use VPN or other tools to circumvent geographic restrictions
Distribute malicious code through or in connection with the Services

Intellectual Property

The Services and their contents, features, and functionality are owned by Kyklops and are protected by applicable intellectual property laws. You may not reproduce, modify, reverse engineer, or create derivative works of the Services without express written permission.

Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KYKLOPS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF DIGITAL ASSETS, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES ARISING FROM: DENIAL-OF-SERVICE ATTACKS, CONDUCT OF THIRD PARTIES, HACKERS, THEFT OF FUNDS, SOFTWARE FAILURES, PROTOCOL CHANGES, INTERNET OUTAGES, FORCE MAJEURE EVENTS, OR ANY CAUSE WITHIN OR OUTSIDE OUR CONTROL.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED $100 USD.

Indemnification

You agree to defend, indemnify, release and hold harmless Kyklops from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Taxes

You are entirely responsible for any tax liability arising from your use of the Services. We do not report, collect, or disburse taxes on your behalf.

Termination

We may suspend or cancel your access to the Services at any time, for any reason or no reason, in our sole discretion and without notice. You hereby release and hold harmless Kyklops from any losses arising from such suspension or termination.

Changes

We may revise these Terms at any time. All changes are effective immediately when made available. Your continued use of the Services constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is held invalid or unenforceable, such provision shall be eliminated or limited to the minimum extent, and the remaining provisions shall continue in full force.

Entire Agreement

These Terms of Use and our Privacy Policy constitute the entire agreement between you and Kyklops regarding the Services.
